Subject : GOI - Addendum No.3 to DGS Order 20 of 2022 Reg. Certification of Offshore Vessels, Accommodation Barges, etc. while operating in Indian Exclusive Economic Zone.

1. Reference is made to the DGS Order 20 of 2022 dated 20.10.2022, specifying requirements for Mobile Offshore Drilling Units (MODUs) and other offshore vessels operating in the Indian Exclusive Economic Zone, with specific compliance under the MODU Code of 1989 or 2009 depending on the year of construction or modification.

2. Subsequently, the Administration issued Addendum No. 01 dated 20.01.2023 and Addendum No. 02 dated 16.06.2023, providing provisions for progressive implementation and extended timelines for compliance of MODU 1979 rigs towards achieving certification under the MODU Code 1989.

3. Indian Administration has now issued Addendum No.3 to DGS Order No.20 of 2022 amending sub-paragraph A.10 of the DGS Order 20 of 2022 as follows:

The existing sub-paragraph A.10:

“Any 'Mobile Offshore Drilling Unit' (propelled/non-propelled) participating in a tender, after the issuance of the Order (i.e. Indian or Foreign), shall comply with the requirements of MODU Code, 1989 or 2009, depending on the year of construction/ modification.”

Revised sub-paragraph A.10

“Any 'Mobile Offshore Drilling Unit' (propelled/non-propelled) participating in a tender, after the issuance of this Order (i.e. Indian or Foreign), must comply with the requirements of MODU Code, 1989 or 2009, before commencement of operations

4. The amendment aims to provide flexibility to stakeholders by allowing participation in tenders by MODUs that have not yet upgraded to the 1989 or 2009 MODU Code but are committed to doing so before commencing operations in Indian waters.

5. This amendment comes into effect immediately and is applicable to all ongoing and future tenders involving Mobile Offshore Drilling Units operating within the Indian Exclusive Economic Zone.

6. All other provisions of the DGS Order No. 20 of 2022 and subsequent addenda remain unchanged and this Addendum is to be read in conjugation with the DGS Order 20 of 2022 and all its addenda.
